RULES FOR USE OF THE HOME BUILDERS ASSOCIATION OF CENTRAL ARIZONA’S MAME AWARDS TRADE NAMES AND MATERIALS (2019)

Purpose

The following rules were designed to ensure the protection of the rights of all MAME Awards winners, to ensure that the public is not mislead into believing that an award or nomination was given, when it was not, and to ensure the protection of the Home Builders Association of Central Arizona’s (“HBACA”) ownership of the “MAME Awards” trade name.

Rules and Permissible Uses

All rules apply to all newspaper and magazine advertising, websites and banner ads, promotional materials, radio and television advertising, and every other form of advertising or promotion.

  1. “MAME Awards” is a trade name owned by the HBACA.
  2. You may use the phrase “MAME Awards” in accordance with the terms of these rules or with the express written consent of the HBACA.
  3. You may use the phrase “MAME Awards” in advertising or promotional materials in accordance with the terms of these rules or with the express written consent of the HBACA.
  4. For MAME Awards recipients, you must specify the year in which the award was won and the category in which the award or nomination was received. You must also specify that the award was presented by the Home Builders Association of Central Arizona. For example: 2019 MAME Awards “Small Volume Builder of the Year” presented by the Home Builders Association of Central Arizona
  5. For recipients of more than one MAME Award, you must include the name of at least one category for which an award was received. You are not required to list all award categories.
  6. For recipients of the “Builder of the Year” award, you may promote yourself as the MAME Awards “Builder of the Year.” In any such promotion, the term “Builder of the Year” must immediately follow “MAME Awards.”  You may not use “Builder of the Year” without the MAME designation. For example: 2019 MAME Awards “Builder of the Year” presented by the Home Builders Association of Central ArizonaNOT – Home Builders Association of Central Arizona’s Builder of the Year 2019
  7. When using the MAME Awards in conjunction with other awards, these rules must be followed.

Penalties for Misuse

If in the sole discretion of the HBACA, any of the above rules have been violated, the violation must be remedied within 10 days following notification of the violation.  Any uncorrected violation may result in withdrawal of the right to use the “MAME Awards” trade name, including without limitation a permanent ban on the use of the name.  In addition, the HBACA may prohibit the violator for future entry into the MAME Awards.
